Proving Negligence in a Car Wreck

It's important to determine who was at-fault for the collision. There are 4 elements of negligence: duty, breach of duty, causation and damages. As a Louisville car wreck attorney, I approach each situation with these elements in mind. Ideally, there's enough evidence to prove the other driver was at-fault in causing the car wreck. My client was injured because the other driver had a duty to control his/her vehicle. That person failed to do so (i.e. breach of duty). That failure caused the collision and resulting injuries. Now, there are medical bills that now need to be paid (i.e. damages).

The facts in some cases are easier to prove than in others. Because we're dealing with the law, it's about what we can actually prove. That's the responsibility of any lawyer, based on the facts of the case.

Attorneys are licensed by individual states. Jim can practice in both Kentucky and Indiana. But what if you're involved in a collision in Florida, Georgia or even Utah?

In most situations, you can hire Jim Desmond to represent you, but he will have to "co-counsel" with an attorney located in the same state where the collision occurred. The laws of that state will control the claim.

Do They Have to Total My Car?

After a car wreck, you may still want to keep your car. Do they have to total your car? The insurance company may not have a choice. State law may require it. I'll explain the answer in this brief video.

In Kentucky, the insurance company is only required to pay you for the value of the car, at the time of the collision, assuming the other person was at-fault. This is called the fair market value. This is NOT the replacement value. Unfortunately, what they pay you may not enable you to get a new car. This is often why people ask if they can keep their car and "drive it ugly." Kentucky state law requires the insurance company to total your car if the repair cost exceed a certain percentage of the fair market value of the car.

Do I Have to Let them Total My Car?

After a car wreck, the insurance company may tell you that your car is totaled. As an experienced, Louisville car wreck attorney, I can't tell you how many times I've been asked, "Do I have to let them total my car?" I'll explain your options in this brief video.

If your car is totaled, you'll typically receive the fair market value for it. This is different from the "replacement cost." Fair market value is what the vehicle was worth immediately before the collision. Unfortunately, if you owe more than the fair market value of the car, you may have to make up the difference. It's not always fair, but it's how our system currently works.

Okay, so now you might be without a your car. In addition to your medical bills, now you have to think about buying another car. This is why your attorney is going to work extremely hard to try to identify any and all sources of insurance that might provide funds, if he/she successfully resolves your case against the at-fault driver. Your automobile insurance may include UM/UIM coverage. But what does that mean?

UM coverage is there in case the at-fault driver didn't have insurance at the time of the wreck. Uninsured Motorist coverage is a contract you have with your own insurance carrier. It protects you in this situation. The insurance money from your UM coverage is a safety net. What if the driver was actually insured, but your medical expenses surpass the amount of insurance he/she had (i.e. the policy limit)? This is when UIM coverage becomes important. Your attorney will file a claim for Under Insured Motorist coverage, again, with your own insurance carrier. Depending on the amount of UIM coverage you have, it can make a significant difference in how the medical bills are paid and if you have funds left over.
