Proving Negligence in a Car Wreck
It’s important to determine who was at-fault for the collision. There are 4 elements of negligence: duty, breach of duty, causation and damages. As a Louisville car wreck attorney, I approach each situation with these elements in mind. Ideally, there’s enough evidence to prove the other driver was at-fault in causing the car wreck. My client was injured because the other driver had a duty to control his/her vehicle. That person failed to do so (i.e. breach of duty). That failure caused the collision and resulting injuries. Now, there are medical bills that now need to be paid (i.e. damages).
The facts in some cases are easier to prove than in others. Because we’re dealing with the law, it’s about what we can actually prove. That’s the responsibility of any lawyer, based on the facts of the case.

There are factors in your situation that may increase the value of your case. For instance, if the at-fault driver was drunk at the time of the car wreck, there are options we can pursue. Watch this brief video for more details: https://youtu.be/sUc0hhrtnwA?si=5FpTHt6XVPduEEpQ
While there are more automobile accidents in Jefferson County and through out Kentucky than you might imagine, it’s a complicated area of the law. Not every attorney has significant experience handling these cases. Many may decide to take your case, but is that really in your best interest? Success in proving negligence in a car wreck depends on a variety of factors. These aren’t easy cases to win, even if you weren’t at fault. Additionally, even if you can prove it was the other person’s fault, it’s still a matter of making sure you get fair compensation for the damages you incurred. Damages can include medical expenses related to your injuries, lost wages because your had to be off of work and obviously the damage to your vehicle. There are other damages that can be claimed, including pain and suffering.
