Answers for Car Wreck Property Damage Claims

Even if there were no injuries in your car wreck, you'll probably want to file a property damage claim against the at-fault driver. Steps to Take before Derby 150

As Louisville prepares for the Kentucky Derby there are important steps to take to protect yourself. Remember, there will be a lot of out-of-town drivers and those who may have "celebrated" before getting behind the wheel. I'll offer some information about uninsured and underinsured motorist coverage. You might want to check your policy and make some changes.

Regardless of how severe your injuries are, the amount you recover from the at-fault driver is usually limited to the amount of insurance coverage they have. However, there are ways to protect yourself from getting stuck with extensive medical bills. Kentucky has no-fault insurance, which is usually automatic coverage for you and each of your passengers. There are other ways you can protect yourself and your family is by making sure you have adequate insurance. Uninsured Motorist coverage (UM), which protect you if someone is driving without insurance. Underinsured Motorist coverage (UIM) can pay for medical bills when they exceed what the at-fault driver has on his/her vehicle.

Unfortunately, if you ride a motorcycle and are involved in a collision, you may not have PIP insurance or no-fault coverage. You can purchase it, but many motorcyclists unfortunately don't. How Do Attorneys Get Paid?

It's one of the most common questions people ask, "How do attorneys get paid?" Jim Desmond is a Louisville automobile accident attorney who has practiced for 25 years. He'll explain the details in this Wave3 TV interview.

Injury attorneys, in Kentucky, are generally handled on a contingency fee basis. This is significantly different from the traditional hourly rate basis. The contingency fee places the risk on the attorney. His or her fee is taken as a percentage of the award or settlement, at the end of the case. Usually, case fees and expenses are also deducted from the award or settlement. A reputable personal injury attorney often pays the expenses related to building the case. One of the first step to be taken after a collision is to get a copy of your police report. There is a lot of very important information contained in that report. Obviously, it should list the name and contact information for the other driver. Your attorney will also need the insurance information, which may be included. It can take time for the police officer to complete the report. In Jefferson County, Kentucky, the police report is not automatically sent to you. You'll have to request a copy, but how and where do you do that? Now that you have a copy of your police report, what do the codes and references mean? They can be confusing. A police report will include the officer's "best guess" as to which driver was at-fault. Interestingly, the report is not considered evidence, because it was completed once the officer arrived at the scene of the wreck. He/she was not actually there when it happened. As stated, the results of a collision with a tractor trailer can be catastrophic, even tragic.
