Do They Have to Total My Car?

After a car wreck, you may still want to keep your car. Do they have to total your car? The insurance company may not have a choice. State law may require it. I’ll explain the answer in this brief video.

In Kentucky, the insurance company is only required to pay you for the value of the car, at the time of the collision, assuming the other person was at-fault. This is called the fair market value. This is NOT the replacement value. Unfortunately, what they pay you may not enable you to get a new car. This is often why people ask if they can keep their car and “drive it ugly.” Kentucky state law requires the insurance company to total your car if the repair cost exceed a certain percentage of the fair market value of the car.
